1. About these terms

These terms govern your use of techspear.in (the "website"), operated by Techspear Software Solutions Private Limited ("Techspear", "we", "us"), Tenkasi, Tamil Nadu, India.

By using the website you agree to these terms. If you do not agree, please do not use it.

2. Our services and project agreements

The website describes the software, web, mobile and design services we offer. It is general information, not an offer that can be accepted.

Any work we do for you is governed by a separate written agreement, such as a proposal, statement of work or contract, signed or accepted by both parties. If that agreement conflicts with these terms, the agreement prevails.

3. Enquiries and quotes

• Sending an enquiry through a form, email, phone or WhatsApp does not create a contract or oblige either party to proceed.
• Budgets, timelines and figures shown on the website are indicative. A quote is binding only when it is confirmed in writing and remains valid for the period stated in it.
• Please make sure the information you send us is accurate and that you are entitled to share it.

4. Using the website

You agree not to:

• use the website for anything unlawful, fraudulent or harmful;
• attempt to gain unauthorised access to the website, its servers or any connected system, or interfere with its security or performance;
• send spam, malware, or automated or bulk submissions through our forms;
• copy or scrape the website’s content in bulk, or misrepresent your relationship with Techspear.

5. Content and intellectual property

The text, design, graphics, logos and code of the website belong to Techspear or our licensors and are protected by intellectual property laws. You may view and share pages for personal or internal business use, but you may not reproduce, modify or reuse the content commercially without our written permission.

Client names, logos and project descriptions shown in our work samples belong to their respective owners. Their appearance on the website does not grant you any right to use them.

Ownership of software we build for a client is set out in that client’s project agreement.

6. Third-party links and services

The website links to services we do not control, such as WhatsApp, LinkedIn, Instagram, Threads, Facebook and our SpearAcademy site. Their own terms and privacy policies apply when you use them, and we are not responsible for their content or practices.

7. Disclaimer

We work to keep the website accurate and available, but it is provided "as is" and "as available". To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.

8. Limitation of liability

To the extent permitted by law, Techspear is not liable for any indirect, incidental or consequential loss, or any loss of profit, data or business, arising from your use of, or inability to use, the website.

Nothing in these terms limits liability that cannot be limited under applicable law. Liability for services we provide is governed by the relevant project agreement.

9. Privacy

How we collect and use personal data is explained in our Privacy Policy at techspear.in/privacy, which forms part of these terms.

10. Changes to these terms

We may update these terms from time to time. The "Last updated" date shows when they last changed. Continuing to use the website after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of India. The courts at Tenkasi, Tamil Nadu have exclusive jurisdiction over any dispute arising from them or from your use of the website.
